Our medical device attorneys are assisting women and families affected by uterine sarcoma. Power morcellators are medical devices used to perform hysterectomies and remove fibroid tumors. Evidence now shows, however, that the spinning blades of a power morcellator can spray hidden cancer cells around a patient’s abdomen and pelvis. If you or a family member was diagnosed with advanced uterine cancer, we invite you to consult an experienced morcellator lawyer in our office and understand your legal options.

Victims Not Warned About Cancer Risk

Morcellators typically use a set of rotating cylindrical blades positioned at the end of a long shaft. The shaft is inserted into the body to reach the uterus, where tissue is then sliced into pieces (or “morcellated”) and extracted through small incisions. Many women undergo the procedure to remove fibroids. In some cases, however, suspected fibroids are biopsied and identified after surgery as uterine sarcoma. If uterine sarcoma was present during morcellation, the procedure can significantly worsen a patient’s prognosis by mincing and dispersing cancer cells throughout the body.

In April 2014, the U.S. Food and Drug Administration warned doctors against using power morcellators in the vast majority of cases. After continued safety concerns, the FDA recommended in November 2014 that the strongest possible safety warnings be included on the product labels for all power morcellators.

Our morcellator lawyers are reviewing evidence that the device makers were aware of significant safety concerns prior to these FDA warnings. Lawsuits are now underway against various manufacturers for claims of negligence, fraud, strict products liability, and breach of warranties.

Gynecologists report rarely having warned their patients about the cancer-spreading risk of power morcellators prior to the FDA action in 2014. This means an untold number of women agreed to undergo laparoscopic hysterectomy or myomectomy procedures with no knowledge of the potential danger. While some morcellators have been recalled from the market, manufacturers have not offered voluntary settlements to victims. At this time, litigation is the only means by which families can obtain compensation and hold the responsible parties accountable.
