Wright Hip Lawsuit – CONSERVE
You may be entitled to file a Wright hip lawsuit if you experienced early device failure or other serious injuries after your hip replacement surgery.
Hip replacements made from all metal components are marketed to younger patients seeking a more durable device and continued physical activity. But metal hip implants have been shown to fail at alarming rates and cause dangerous side effects.
Wright Medical’s CONSERVE hip replacement is among the class of metal-on-metal (or MoM) hip replacements subject to ongoing litigation throughout the United States. If you received a CONSERVE implant, contact our office to discuss your case and understand your legal options.
Metal Hip Injuries
Patients implanted with Wright’s CONSERVE hip replacement and other MoM devices report the following complications:
- Pain in the hip and groin
- Loosening of the device
- Dislocation
- Shedding of metal particles into the bloodstream
- Tissue necrosis
- Metal toxicity
- Early revision surgery
By filing a Wright hip lawsuit, patients can attempt to recoup their medical costs and receive compensation for unnecessary physical, emotional, and financial harm.
Wright Metal Hip Recall Not Yet Issued
Despite a high incidence of device failure and the potential for serious side effects, neither the FDA nor the manufacturer has issued a Wright metal hip recall. This means the implants are still on the market and available for use in new patients. This also means that patients who already received a Wright CONSERVE metal hip may not be aware of the potential complications their device can cause.
Wright Hip Lawsuit Settlement
In the absence of a recall or compensation program, victims must consider a Wright hip lawsuit if they wish to recover legal damages. A centralized federal proceeding has been established in the United States District Court for the Northern District of Georgia (Case No. 1:12-md-2329-WSD). Other cases are pending in various state courts around the country.
[SETTLEMENT UPDATE]: In November 2016, Wright Medical agreed to a $240 million settlement in the federal proceeding. Under the terms of the agreement, patients who underwent revision surgery for their CONSERVE implant are eligible to receive $170,000. The agreement is designed to resolve the majority of pending cases against Wright’s line of metal hip devices. New claims, however, may still be included in future settlements. Accordingly, patients are encouraged to consult a lawyer to protect their right to compensation.
