Stryker Hip Attorneys Allege Failure to Warn

Stryker recalled its Rejuvenate and ABG II metal hip implants in July 2012 amid growing international concern over the safety of metal hip replacements. Our Stryker hip attorneys are evaluating evidence that suggests the company knew of serious safety risks but failed to adequately warn doctors and patients before the recall.

In May 2012, Canadian authorities issued a public health communication to orthopedic surgeons and patients about metal hips. The government warned of increased incidence of pain, implant loosening, and significant soft tissue reactions caused by metal debris.

In June 2012, the UK health agency issued a medical device alert recommending follow-up care for patients with metal-on-metal hip replacements, including blood tests, imaging, and possible revision surgery.

Australian health regulators published similar safety information relating to metal hips in September 2012.

The Stryker hip attorneys at our firm believe the company had evidence of these early failures and side effects before government regulators began to issue public warnings. In addition, our Stryker attorneys believe the company failed to properly test their products in controlled clinical studies before widely marketing the devices to consumers in the U.S. and around the world.

Stryker Hip Settlements

In December 2013, Stryker settled the first four lawsuits in an ongoing New Jersey state court proceeding. While the settlement amounts were not made public, the company estimated that it would cost a total of $1.1 billion to settle personal injury claims over its recalled metal hips replacements. In November 2014, a Stryker settlement was announced in the amount of $1 billion to settle claims in both federal court and in the coordinated New Jersey action. Under the terms of the agreement, patients who have not yet filed a lawsuit but who develop injuries in the future may still qualify for the Stryker settlement. Negotiations are expected to be ongoing between the device manufacturer and individual Stryker hip law firms to move more claims toward resolution.
