In April 2012, Stryker Orthopaedics issued a field safety notice to surgeons and hospitals regarding the company’s metal hip implants. The company warned that the devices could fail due to corrosion and fretting of the metal components. Shortly thereafter in July 2012, Stryker issued a nationwide recall of its Rejuvenate and ABG II modular-neck stems in light of growing safety concerns. Stryker Lawsuits Follow Device Recall

The first Stryker hip replacement lawsuit following the recall was filed in August 2012 in New Jersey state court. The plaintiff alleged injuries such as pseudotumor and fluid around the device, heavy metal ion contamination in the blood, and invasive revision surgery by a trauma specialist. The lawsuit set forth claims against the company for negligence, breach of warranties, failure to warn, design defect, and loss of consortium.

In September 2012, seven more plaintiffs filed suit against Stryker in New Jersey for defective hip replacements. All seven lawsuits alleged metal poisoning and complicated revision surgeries.

In January 2013, the New Jersey Supreme Court consolidated 50 Stryker hip lawsuits as a multicounty litigation in Bergen County (Case No. BER-L-936-13). The court ordered that all present and future Stryker lawsuits filed in the state be assigned to the same court in Bergen County before Judge Brian R. Martinotti. The court ordered the consolidation in light of the common issues of law and fact alleged in the lawsuits, namely, legal damages relating to heavy metal contamination and device failure.

A similar program was established in federal court in June 2013. All Stryker hip replacement lawsuits in federal courts around the country have been centralized into a multidistrict litigation in the District of Minnesota (MDL No. 0:13-md-02441).
