Biomet Hip Lawsuit – M2a Magnum
Biomet manufactures the M2a Magnum hip replacement. The device is made from metal components, which the company claims will last longer and allow patients greater mobility. As with other metal-on-metal hip replacements, a growing number of patients report serious complications after receiving these implants. In January 2014, Biomet agreed to pay $56 million to settle a federal court proceeding over the company’s metal hip implants (MDL No. 2391 in the U.S. District Court for the Northern District of Indiana). Biomet agreed to compensate patients who required revision surgery after being implanted with the company’s M2a-38 or M2a-Magnum hip device. Other Biomet hip lawsuits are still pending in state court actions throughout the country.
In a separate proceeding in March 2012, Biomet settled charges by the Securities and Exchange Commission and the U.S. Department of Justice over bribery of surgeons in foreign countries. The government charged that Biomet paid kickbacks to public surgeons in Argentina, Brazil, and China for nearly a decade to use the company’s orthopedic products. Biomet settled the SEC’s charges as well as the DOJ’s criminal charges for a total of $22 million.

Biomet’s hip settlement resolved personal injury claims that were pending in the federal court proceeding at the time of the agreement.
