Zofran (ondansetron) is widely used to treat nausea and vomiting during pregnancy. However, the drug is not FDA-approved for morning sickness. Zofran Class Action Not Formed

Despite widespread use of the drug, a Zofran class action lawsuit has not been established. Rather, Zofran birth defect cases are filed on an individual basis. This allows each family to be represented by their own attorney, litigate the facts of their own case, and pursue compensation for the unique legal damages they experienced.

By contrast, a Zofran class action would consist of a single lawsuit filed on behalf of all claimants nationwide or within a given state. At the end of the case, any recovery would be divided among the class members according to general injury categories.

Given the complexity of the legal issues and the sensitive nature of birth defect injuries, Zofran cases can be more fairly resolved on a case-by-case basis than under the class action system.

Studies Show Increased Risk of Birth Defects

In October 2014, international researchers published findings that use of Zofran in the first trimester was associated with a statistically significant increase in cardiovascular defects and cardiac septum defects in newborns. Prior studies reported that Zofran use in the first trimester was associated with a two- to four-fold increase in the prevalence of atrial septal defects (ASD), ventricular septal defects (VSD), and atrioventricular septal defects (ASD).
