Talcum Powder Settlement May Follow Jury Trials
Before the parties can reach a comprehensive talcum powder settlement, a certain number of individual claims will proceed to jury trials.
This allows the parties to better understand the strengths and weaknesses of the case and helps inform broader settlement discussions.
To date, three talcum powder lawsuits have gone to trial. In all three cases, the juries returned findings of negligence against Johnson & Johnson while awarding significant money damages in the two most recent cases.
- $55 Million Verdict (May 2016): Plaintiff Gloria Ristesund sued Johnson & Johnson in Missouri state court after she was diagnosed with endometrioid ovarian cancer at age 57. At trial, the jury reviewed internal company documents indicating J&J was aware for decades that talc posed a cancer risk yet continually failed to warn its customers. The jury awarded Ristesund $5 million in compensatory damages and an additional $50 million in punitive damages. (Ristesund v. Johnson & Johnson, 22nd Judicial Circuit of Missouri, Case No. 1422-CC09012-01)
- $72 Million Verdict (February 2016): Jacqueline Fox of Alabama died from ovarian cancer after using Baby Powder in the genital area for several decades. Based on the evidence presented against Johnson & Johnson, the jury found the company liable for negligence, conspiracy, and failure to warn. The jury awarded the Fox estate $10 million in compensatory damages and $62 million in punitive damages. (Tiffany Hogans et al., v. Johnson & Johnson, 22nd Judicial Circuit of Missouri, Case No. 1422-CC09012)
- Finding of Negligence (December 2013): Deane Berg sued Johnson & Johnson in South Dakota federal court alleging the company knew its Baby Powder and Shower to Shower could cause ovarian cancer. She was diagnosed at the age of 49, though her cancer was in remission by the time of trial. The jury did not award the plaintiff monetary damages but still found J&J liable for negligence. (Berg v. Johnson & Johnson, U.S. District Court for the District of South Dakota, Case No. 4:09-cv-04179)
Additional trials are scheduled to proceed as the parties consider whether to enter a talcum powder lawsuit settlement.
