Lipitor is reported to be the world’s best selling drug with annual sales of $7 billion. The drug is widely prescribed to lower cholesterol, reduce the risk of heart attack and stroke, and avoid the need for surgery in patients with heart disease.

Medical studies now show, however, that Lipitor can cause Type 2 diabetes in women with no personal or family history for the disease.

If you were diagnosed with new-onset diabetes mellitus while taking Lipitor, you may have grounds to file a Lipitor lawsuit against the manufacturer.

Lipitor Lawsuits Allege Failure to Warn

In February 2012, the U.S. Food and Drug Administration required that Lipitor and other statin drugs include warnings about elevated blood sugar. At that time, the warning label for Lipitor was updated to include the following language:

“Increases in HbA1c and fasting serum glucose levels have been reported with HMG-CoA reductase inhibitors, including LIPITOR.”

Lipitor lawsuits allege that this warning failed to explicitly inform patients about the risk of developing Type 2 diabetes with use of the drug. Our lawyers are also reviewing evidence that the manufacturer may have known of the risk of diabetes well before the 2012 FDA label change.

About the Lipitor Class Action Lawsuit

A Lipitor class action lawsuit has not been formed in the United States. Instead, each plaintiff files suit individually and litigates the specific facts of her case.

While a single Lipitor class action is not in place, a centralized proceeding has been established for all Lipitor cases filed in federal courts. In February 2014, a multidistrict litigation (or MDL) was formed in the District of South Carolina (case no. 2:14-mn-02502-RMG). Over one thousand cases are now part of the MDL, which coordinates all federal cases for pretrial purposes but preserves individual claims. Depending on the facts of your case, your Lipitor lawsuit could be joined with the federal MDL or filed as a separate state court action.
