Defective Drug Lawsuits
Despite FDA oversight, many dangerous medications are approved for sale in the U.S. and cause serious harm to patients. When this occurs, victims must often pursue litigation against the manufacturer to receive compensation for significant injuries and expenses.
Recent Defective Drug Lawsuits
- Invokana – The prescription diabetes medications Invokana and Farxiga have been linked to dangerous side effects including limb amputations and diabetic ketoacidosis.
- Yaz – The popular Yaz, Yasmin, and Ocella birth control pills were shown to present a six fold (6x) increase in the risk of blood clots when compared to nonusers. These drugs were heavily advertised even though safer alternatives had been available to women for years.
- Risperdal – The antipsychotic drug Risperdal was promoted “off-label” (meaning without specific FDA approval) for use in children and adolescents. Hundreds of users contacted our firm with reports of gynecomastia, a troubling side effect that causes breast growth in young males.
- Lipitor – The cholesterol-lowering drug Lipitor is the best selling pharmaceutical product in history. Yet medical studies show the drug may cause new-onset Type 2 diabetes in patients with no risk factors for the disease.
- Tylenol – Tylenol, previously regarded as one of the safest products in modern medicine, has been linked to a serious risk of liver failure at high doses.
Patient Safety or Profits?
Like any corporation, drug companies must earn profits to advance their business. In fact, corporate law obligates those who run a corporation (its officers and directors) to act in the best interests of the company’s shareholders.
This system, however, can also put patient safety in peril. Our attorneys have litigated dozens of cases where companies aggressively marketed their products to consumers despite a known risk of dangerous side effects.
Defective drug lawsuits are designed to determine whether a product is unreasonably dangerous, whether the manufacturer knew of the potential defects, and whether the company failed to properly warn doctors, patients, and government regulators.
Most importantly, civil litigation is the only recourse for patients exposed to unnecessary side effects and expenses.
