Morcellators Class Action Lawsuit
Power morcellators are gynecological tools used to perform hysterectomy or uterine fibroid removal. In November 2014, the U.S. Food and Drug Administration issued an urgent safety warning against use of the devices because they can rapidly spread hidden cancer cells. Lawsuits are now underway to compensate women and families for the manufacturers’ failure to warn of these dangerous side effects. Morcellators Class Action Not Yet Formed
Prior to the FDA’s safety announcement, approximately 55,000 women underwent morcellation procedures in the U.S. each year. Evidence now shows that these patients were exposed to the potential spreading of uterine sarcoma, an aggressive form of cancer that can be mistaken for fibroid tumors.
Although fibroids are common and usually benign, some are diagnosed after surgery as malignant cancer cells. When spinning morcellator blades cut this tissue, cancerous fragments can spray into the abdomen and pelvis and significantly worsen a patient’s prognosis for long-term survival.
Despite the large number of women affected, a morcellators class action lawsuit has not been established to compensate women diagnosed with uterine sarcoma after surgery. Instead, each claimant must file a separate morcellator lawsuit to receive compensation from the makers of these devices.
In the absence of a morcellators class action, our medical device attorneys are helping individual victims prepare and file their claims.
Lawsuits Allege Negligence, Fraud, and Failure to Warn
Our attorneys are reviewing evidence that the manufacturers of power morcellators may have failed to disclose important safety concerns to doctors and patients. Medical journals dating as far back as 1995 suggest a link between cutting (or “morcellating”) uterine fibroids and the risk of spreading unsuspected sarcoma throughout the body. Lawsuits allege that the manufacturers were aware of safety concerns well before the FDA’s warnings in 2014 but continued to promote the devices as safe and effective.
