$3 Billion Settlement in Government Fraud Case
In July 2012, GlaxoSmithKline, the manufacturer of Zofran, pled guilty to three misdemeanor violations of the Food, Drug, and Cosmetic Act in an action prosecuted by the U.S. Department of Justice. The criminal violations included false and misleading labeling, inadequate directions for use, and failure to report safety data to the FDA concerning the drugs Paxil, Wellbutrin, and Avandia. The company agreed to pay $1 billion in criminal penalties.
As part of the same resolution, GlaxoSmithKline agreed to pay $2 billion in civil damages to federal and state health care programs. The civil damages were paid to resolve allegations relating to kickbacks and off-label promotion of Zofran, Paxil, Wellbutrin, and other drugs.
The government alleged that the manufacturer promoted Zofran for uses that were not approved as safe and effective by the FDA, specifically, morning sickness in pregnant women.
Also under investigation was the company’s alleged payment of kickbacks and incentives to induce doctors to prescribe Zofran and other medications.
The Department of Justice accused the company of “critically undermining doctors’ independent clinical judgment” and jeopardizing public health.
The settlement terms require increased monitoring of the drug maker and prohibit the company from compensating its reps based on sales volume.
