Zofran (ondansetron) is used to control nausea and vomiting in patients who undergo chemotherapy, radiation therapy, or surgical procedures. The FDA has not approved Zofran to treat morning sickness during pregnancy. In fact, the manufacturer of the drug never conducted clinical trials to test Zofran as a morning sickness treatment.

Instead, the company is believed to have persuaded doctors to prescribe Zofran “off label” for common pregnancy-related nausea without regulatory approval and despite potential risks to newborn children.

Post-marketing studies now suggest that use of Zofran during the first trimester of pregnancy may be associated with an increased prevalence of birth defects, including:

  • Heart defects
  • Orofacial clefts
  • Other congenital malformations

If your family has been affected, you may wish to consult a Zofran lawyer about your legal options.

Is There a Zofran Class Action?

No, the Zofran birth defects litigation is not a class action lawsuit. In a Zofran class action, a single lawsuit would be filed on behalf of all claimants, with any recovery in the case divided among those who join the class.

Rather, given the complexity and sensitive nature of birth defect injuries, each claim is filed as an individual lawsuit. This means you will have your own Zofran lawyer to represent you and guide you through the litigation process. This also means any recovery in your case will be awarded according to the unique legal damages you and your family experienced.
