Saturday September 13, 2025 — Breast cancer patients who experienced permanent hair loss may have grounds to pursue a Taxotere lawsuit.

Over 1,100 Taxotere lawsuits have now been filed in a growing federal litigation with additional cases pending in various state courts around the country.

Plaintiffs allege Taxotere’s manufacturer was aware of the risk of permanent hair loss (or, alopecia) but failed to warn doctors, patients, and government regulators.

Taxotere Hair Loss Lawsuit Allegations

The legal case against Taxotere is based on the following alleged misconduct by the drug’s manufacturer, pharmaceutical giant Sanofi-Aventis:

  • Taxotere’s design makes it more toxic than competitor drug Taxol, but fails to improve clinical outcomes for patients.
  • A 2008 study published in the New England Journal of Medicine concluded that Taxotere, in fact, proved less effective than Taxol in achieving disease-free and overall survival in women with breast cancer.
  • Despite clinical data to the contrary, the manufacturer continued to promote the “superior efficacy” of Taxotere to oncologists.
  • As a result, in May 2009, the U.S. Food and Drug Administration issued a warning letter to Sanofi-Aventis. The FDA cautioned the company that its efficacy claims were unsubstantiated, and that its promotional materials were false and misleading under the Federal Food, Drug, and Cosmetic Act, 21 U.S.C. §§ 352(a) and 321(n).
  • Further, the company was aware in 2005 of a study known as GEICAM 9805 which found that 9.2% of patients treated with Taxotere experienced prolonged or permanent hair loss.
  • The company failed to disclose the risk of permanent alopecia to Taxotere patients in the U.S. until 2015, nearly 20 years after the FDA first approved the drug for sale.
  • In its revised prescribing information, the company now states, “Cases of permanent alopecia have been reported.” Under Patient Information, the label provides simply, “In some cases (frequency not known) permanent hair loss has been observed.”

Thus, plaintiffs allege the manufacturer knowingly exposed breast cancer patients to an unnecessary risk of permanent alopecia without greater efficacy of treatment, while at the same time driving Taxotere sales to over $1.4 billion per year.

Taxotere lawsuits set forth the following claims for relief (or, legal counts) against the defendants:

Is There a Taxotere Class Action Lawsuit?

Taxotere permanent hair loss cases are filed on an individual basis and not as part of a class action proceeding.
